The Conveyancing Process in the Hills District, Step by Step

Stage 2. Exchange of Contracts

We conduct all required searches, request council and water certificates, review any easements or covenants, liaise with your lender to prepare loan documentation, and set up the PEXA workspace for settlement. Stage 4. Settlement Day

Funds are exchanged electronically through PEXA. The title transfers to your name and is registered with NSW Land Registry Services. We confirm completion to all parties and let you know the moment it is done, usually the same moment your agent releases the keys.

While it is technically legal to handle your own conveyancing in NSW, it is strongly inadvisable. A licensed conveyancer will identify risks, conduct all required searches, negotiate contract conditions on your behalf, and manage the PEXA settlement process. A single missed search or overlooked clause can cost far more than the conveyancing fee itself.

Residential buyers in NSW have a five-business-day cooling-off period after contracts are exchanged, during which you can withdraw from the purchase by forfeiting 0.25% of the purchase price as a penalty. The cooling-off period does not apply to properties purchased at auction or where a Section 66W certificate has been exchanged.

Searches vary depending on the specific suburb and council area. Standard searches include a title search, planning certificate, Section 10.7, from The Hills Shire Council or Blacktown City Council as applicable, water and sewerage search, land tax clearance, and a PEXA identity verification. What’s Involved In Conveyancing During The Selling Process?

In some ways, conveyancing throughout the sale process is very similar to buying, but there are a few differences.

  • Preparing the contract of sale. We’ll help you create a contract of sale, including any special conditions you might need in your circumstances. We’ll continue to negotiate the contract until you and the buyer are satisfied.
  • Searches and disclosures. If anything about the property needs to be disclosed, it’s important to do so in a vendor disclosure statement. We’ll conduct a boundary survey to make sure the boundaries of your property are accurately represented, and we’ll check with the local council to ensure that all structures on the property are legal.
  • Checking over documentation. We’ll make sure the buyer has completed all the necessary conditions of the contract before you sign.
    Managing settlement. Your conveyancer will organise a settlement date, liaise with the buyer’s conveyancer, complete and submit all legal documentation, and we’ll make sure the full agreed-upon amount is paid to you.
